3. Purposes of data processing, legal basis and legitimate interests pursued by the controller or a third party, and categories of recipients

3.1.             Accessing our websites/applications

3.1.1.          Log files

Whenever you access websites/applications, information is transmitted by the relevant Internet browser of your terminal device to the server of our website/application and temporarily stored in certain files known as log files. The records stored here contain the following data, which is held on file until its automatic erasure: Date and time of access, name of the page accessed, IP address of the device requesting access.

The legal basis for processing of the IP address is Article 6 para. 1 point f) GDPR. Our legitimate interest ensues from the

  • guarantee regarding establishment of a trouble-free connection,
  • guarantee regarding comfortable usage of our website/application,
  • analysis of system security and stability.

It is not possible to directly establish your identity with this information, and nor do we ever do so.

The data is stored and automatically deleted once the above purposes have been achieved. The prevailing periods for the deletion of data are determined by the criterion of necessity.

 

3.1.2. Social media plugins

On our website you can also find "social plugins" such as the Xing and LinkedIn button. We have opted for a solution in line with the data protection legislation, not incorporating the plugins directly, but making them available as a link only. In this way we prevent the unwitting and unwanted collection and transfer of data to the individual service providers. We ourselves do not capture personal data via these social plugins or through their usage.

 

3.2 Newsletter

Our websites/applications offer you the option to register for our newsletters. To ensure that no errors come about when entering the email address, we use what is known as the double opt-in procedure (DOI procedure): Once you have entered your email address in the registration field and given your consent to receive our newsletters, we then send you a confirmation link to the address you specified. Only when you click on this confirmation link will your email address be included in our distribution list for mailing our newsletters. The legal basis for this data processing is Article 6 para. 1 point a) GDPR.

Information on right of revocation

You can revoke your consent at any time with effect for the future by contacting info@baur-fs.de, or by using the Unsubscribe option at the end of every newsletter.

 

3.3 Online presence and website optimization
3.3.1 Cookies – General information


We use cookies on various pages to make visiting our website appealing, to permit the use of certain functions, and to compile statistics on the usage of our website. Cookies are little text files which are automatically generated by your browser and are stored on your terminal device (laptop, tablet, smartphone, etc.) when you access our site. Click on the tab "Privacy".

You can now select the security settings for the Internet zone. You can specify here if and which cookies you wish to accept or reject.

Confirm your selection with "OK".

 

In Firefox:

In the "Options" menu select the item "Settings".

Click on "Privacy".

In the drop-down menu select the item "Use custom settings for history".

You can now specify if cookies are to be accepted, how long you wish to keep them for, and add any exceptions to specify which websites are always or never to be allowed to use cookies.

Confirm your selection with "OK".

 

In Google Chrome:

Click on the Chrome menu in the toolbar of your browser.

Now select "Settings".

Under "Privacy and security" click on "Content settings".

Where these cookies and/or the information they contain involve personal data, the legal basis for data processing is Art. 6 para. 1 point f) GDPR. The legitimacy of processing as defined by the above provision can be seen here to derive from our interest in optimizing our website.

 

3.3.2 Google Analytics

In accordance with Article 6 para. 1 point f) GDPR, we employ Google Analytics, a web analysis service of Google Inc. ("Google"), to ensure demand-oriented design and continuous optimization of our website. Google Analytics uses "cookies", which are text files stored on your computer and which allow your use of the website to be analyzed. Pseudonymized user profiles are created in this context, and cookies are used here. The information generated by the cookie on your usage of this website includes data such as

  • Browser type/version,
  • Operating system used,
  • Referrer URL (the page previously accessed),
  • Host name of the accessing computer (IP address),
  • Time of the server inquiry.

Instead of using the browser add-on, in particular with browsers used on mobile terminals, you can also prevent collection by Google Analytics by diesen Link klicken. 3.3.3 Google Adwords

Our website uses the service Google Adwords. Google AdWords is an online advertising program of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

Here we use the remarketing function within the Google AdWords service. With the remarketing function we can show users of our website advertising based on their interests on other websites within the Google display network (on Google itself, "Ads by Google", or on other websites). The interaction of users of our website is analyzed for this purpose, e.g. to see which offers interested the user in order to display targeted advertising to users on other pages including after they accessed our website. To this end, Google stores a number in the browsers of users who access certain Google services or websites within the Google display network. The access made by these users is captured by this number, which is referred to as a "cookie". This number is used to uniquely identify a web browser on a certain computer and not to identify an individual; no personal data is stored here. The legal basis for this data processing is Article 6 para. 1 point f) GDPR.

The legal basis for this data processing is Art. 6 para. 1 point a), Art. 6 para. 1 point b), Art. 6 para. 1 point c) and Art. 6 para. 1 point f) GDPR.

 

4. Your rights

4.1.Overview

Besides the right to revoke any consent you have given us, you also have the following additional rights subject to the relevant statutory conditions:

  • the right to access personal data we have stored about you (Art. 15 GDPR). In particular, you can request information on the purposes of processing, the categories of personal data concerned, the categories of recipients to whom your data has been or will be disclosed, the storage period envisaged, the source of your data where not directly collected from yourself;
  • the right to rectification of incorrect data or to the completion of correct data (Art. 16 GDPR),
  • the right to erasure of the data we have stored about you (Art. 17 GDPR), unless we need to comply with statutory or contractual data retention periods or other statutory obligations, or have rights regarding further storage, 
  • the right to restrict the processing of your data (Art. 18 GDPR), where the accuracy of the data is contested by yourself, processing is unlawful, but you oppose its erasure; the controller no longer needs the data, but you require it for the establishment, exercise or defence of legal claims, or you have objected to processing pursuant to Art. 21 GDPR,
  • the right to data portability according to Art. 20 GDPR, i.e. the right to receive selected data we have stored about you in a commonly used and machine-readable format, or to request its transmission to another controller
  • the right to lodge a complaint with a supervisory authority. In this regard you can generally apply to the supervisory authority at your habitual residence, place of work or the registered office of our company.

4.2 Right to object

Under the prerequisites of Art. 21 para. 1 GDPR, it is possible to object to data processing on grounds relating to the particular situation of the data subject.

The above general right to object shall apply to all purposes of processing described in this Data Protection Information which is performed on the basis of Article 6 para. 1 point f) GDPR. Unlike the special right to object to data processing for advertising purposes, we are only obliged under GDPR to implement such general objection where you demonstrate to us overriding reasons for doing so (e.g. a possible risk to life or health).

 

4.3 Right of revocation

Insofar as we process data based on the consent you gave us, you have the right to revoke such consent at any time. The revocation of consent does not render invalid the data processing performed on the basis of consent until the time of revocation.

 

5. Data security

5.1. Warning regarding falsified emails (spoofing), spam and phishing

For us, the security of the data belonging to our customers is a top priority. We would like to offer you below a few tips on security.

Beware of phishing and spoofing attempts

The sender address of BFS has unfortunately also been the subject of misuse with this type of fraud. In specific terms, it means that consumers receive emails in the name of BFS, but which are in fact false. As these emails are often even modelled on the BFS brand layout, it can sometimes be difficult to distinguish them from genuine emails sent by BFS.

Fraudsters aim to exploit the relationship of trust existing between BFS and our customers and either steal sensitive information, or install malicious software (such as virus or Trojans) on your computer or smartphone.

These emails were not created and sent out by BFS, even where our name is shown as the sender. This means that BFS is unfortunately not able to influence the dispatch of such unauthorized emails.

Please see below for a few features by which you can identify emails from BFS:

  • BFS will not ask you for personal information by email, nor will it ask you to confirm personal data via a link in an email.
  • BFS sends out emails with file attachments only if you have explicitly asked us to do so (e.g. operating instructions).
  • Mails from BFS should not include any typographic or grammatical errors, as they are always proofed prior to mailing.


This is how you should respond to spam, phishing and spoofing emails:

  • We recommend immediately deleting any emails that look suspect.
  • Where emails look suspect, do not open links or attachments and or disclose personal data under any circumstances.
